SECTION 1 – PROTECTIVE SCOPE
The terms of transport in Argentina are subject to the provisions established by Law 18829, in agreement with Section 26 of Law 2182/72.

Without prejudice to the terms established in Section 1 of the General Terms of Business, the present Particular Terms of Business will regulate the supply of vehicle rental offered by Argentina Excepcion.

Argentina Excepcion offers, independently, vehicle rental in most regions across Argentina. To those effects, the company hires a sole Supplier established in each one of these regions (hereinafter, “the Supplier”).

The reservation before Argentina Excepcion constitutes a promise of placing, at the Buyer’s disposition, the rental of a vehicle. The supplier will enter into an agreement, in compliance with the Argentine law, at the time of the delivery of the vehicle.

The solicitude of these products is reserved exclusively to persons:

• of at least 21 years of age,
• who possess driving license issued in country of origin,
• who possess valid ID or passport,
• who possess a credit card at the time of retrieving the vehicle from the Supplier’s office,
• who commit to the vehicle rental for at least 24 hours.

Note: when the Buyer presents himself to retrieve the vehicle, he must leave his credit card information as a warrantee.

SECTION 2 – PRODUCT DESCRIPTION

Argentina Excepcion offers, independently, vehicle rental in most regions across Argentina. To those effects, the company hires a sole Supplier established in each one of these regions: Budget.

Due to technical reasons and/or notwithstanding the willingness of Argentina Excepcion, particularly in the force majeur hypothesis or due to acts generated by a third party, a vehicle initially booked may be replaced by another vehicle of equal category, providing equivalent characteristics.

SECTION 3 – PRICING

3.1. Pricing definition

The description of the services offered on the Website explicit, for each service, the Products included in the price. Prices are expressed in United States Dollars (USD) and per vehicle, taxes included (unless stated otherwise).

The announced prices include:
• the Civil Liability Insurance provided by our Supplier
• maintenance,
• vehicle replacement in case of accident or failure
• immediately at any of our Supplier’s offices, during business hours,
• in 24 to 72 hours if away from the Supplier’s offices or outside business hours,
• with replacement vehicles subject to availability.
• medical assistance and towing within 24 hours.

The announced prices do not include:
• fuel,
• tolls,
• transit fines,
• excess hours and mileage,
• drop-off charges,
• outbound transfers from place of delivery,
• additional option for reducing deductibles,
• insurance for loss or theft of tires, rims, audio system, vehicle accessories,
• all other services not expressly stated in the reservation confirmation.

Additional expenses:
• Rentals carried out at airports will have an additional cost of USD 4 to USD 20 (four to twenty United States Dollars), depending on the city.
• The Supplier will charge the Buyer an excess for services if the Buyer does not return the rented vehicle with the same amount of fuel it had at the time of the delivery.
• The Buyer must pay out the Supplier all the expenses surpassing the amount of the rental voucher.
• If the Buyer requests different services than the ones stated on the voucher, the Supplier reserves the right to charge administrative expenses according to the valid rates for carrying out the requested modification.
• If the Buyer returns the vehicle outside business hours and is not present for agreement termination, he will assume the responsibility for the vehicle’s content and the expenses described in the aforementioned agreement.

3.2. Pricing revision/modification

The prices displayed on the Website may be modified at any given time, without prior notice, these modifications not begin enforceable to the Buyer once the Solicitude Ratification has been carried out.

This notwithstanding, the prices of the Products will be susceptible to revision, respecting increases as well as reductions, in case of variation of royalties and tax amounts. If prices are revised due to one of the aforementioned causes, the variations will only be applied proportionally in the calculation of the price.


SECTION 4 – INSURANCES AND DEDUCTIBLES

4.1. Insurances and deductibles included (LDW)

The price includes Civil Liability towards third parties, in vehicles or on foot, for damages to objects and persons.

The driver is responsible for his vehicle from the start of the rental agreement to its termination. Consequentially, a non reducible deductible will apply in case of sinister, theft or damage. The amount will vary according to the category of the rented vehicle. We invite you to consult our price list to obtain further information.

Exclusions and annulations of LDW (Loss Damage Waiver):
• driver not authorized by the agreement,
• unintentional damage,
• damages caused by drunk driving or under the effects of stupefacient substances as well as driving outside the infrastructure destined to the circulation of vehicles,
• damages related to: the transport of excess weight; the transport of inflammable or explosive material; participation in auto competitions, racing or driving classes; pushing, pulling or towing a rented vehicle; the use for illegal purposes or in violation of traffic laws or any legal or regulation provisions; driving in countries not authorized by the rental agreement.

4.2. Option for reducing the deductible (CDW)

By paying a daily additional sum (CDW) the deductible may be reduced according to the list which appears in our tariffs chapter. The option for reducing the deductible does not correspond in case of overturning. For a monthly rental, a maximum

SECTION 5 – RESERVATION

5.1. Availability verification

LThe Buyer may freely interrogate Argentina Excepcion on the Product characteristics by telephone or fax at (0054) 11 4772 6620, or by e-mail to info @ argentina – excepcion . com, completing the form provided for these effects on the Website or directly at out agency, located at Costa Rica 5546 – 6° Floor, Apartment “606” – (C1414BAA) Buenos Aires – Argentina.

If the Product is available on the established dates, Argentina Excepcion will send the Buyer a detailed description of the Product stating, particularly, the Particular Terms of Business of the product, accompanied by a registration form.

5.2. Ratification of the solicitude by the Buyer and registration form

If the Buyer wishes to ratify his Product solicitude, that is, to accept the General Terms, the Particular Terms of Business and the Product characteristics as defined in the description, he must send Argentina Excepcion a copy of the registration form properly completed and signed, accompanied by a down payment in compliance with the provisions of Section 6.2.

The concrete reservation and the sale of the Product will materialize with the reception of the registration form and the down payment.

5.3. Ratification of the reservation by Argentina Excepcion

From the moment of the reception of the registration form, if Argentina Excepcion ratifies the reservation (hereinafter “Reservation Ratification”), Argentina Excepcion will proceed to debit the aforementioned down payment (or, where appropriate, the totality of the trip amount) without the need of any additional procedures for the ratification of the reservation and the sale of the Product.

If the reservation cannot be ratified, Argentina Excepcion will notify the Buyer within a maximum period of 3 days from the reception of the registration form. In this case, the initial registration form will lose validity and Argentina Excepcion will propose the Buyer diverse equivalent activities, whenever possible, under the conditions requested by the Buyer. The Buyer will enjoy ample freedom to carry on with these new proposals which will require a new registration form.

5.4. Reservation voucher

After payment of the totality of the services is carried out according to the terms established in Section 6.2., Argentina Excepcion will send the Buyer a confirmation e-mail with a reservation voucher attached. This e-mail will compile all data relative to the reservation as well as other complementary information regarding the service. The reservation voucher serves as a warranty. The client must present it before the supplier at the moment of his arrival.

SECTION 6 – PAYMENT

6.1. Payment methods

•The imbursement of the cost of the hired Products can be carried out to Argentina Excepcion, communicating the number of the bank card of the Buyer through a secure payment system provided by HSBC Bank – Bank Argentina S.A., located on 1631 Callao Avenue – C1024AAC – Buenos Aires, Argentina.

•The imbursement of the cost of the hired Products can be carried out to Argentina Excepcion by means of a bank wire directed to HSBC Bank – Bank Argentina S.A., located on 1631 Callao Avenue – C1024AAC – Buenos Aires, Argentina, according to the account presented at the time of carrying out the purchase.

If payment is carried out by means of a bank card, the Buyer must send the agency a signed authorization to extract money from his bank account, by fax or e-mail with the scanned document. The model will be provided by Argentina Excepcion. The Buyer must mention, at the time of the solicitude, the bank card number and name of the holder, the card verification code (the three last digits on the back) and its expiration date. The accepted bank cards are Visa, Master Card and American Express.

The down payment will be debited through the bank card at the time of the confirmation from the suppliers. The debit will not be carried out if Argentina Excepcion cannot respond satisfactorily to the request or if it is a mere proposition (unconfirmed).

If payment is carried out by means of an international bank wire, no special procedure will be necessary. This notwithstanding, the Buyer acknowledges that a delayed payment gives arbitrary character to the ratification of the reservation and the effective purchase of the Product.

6.2. Payment procedures

The payment procedures differ if there are 7 days or less left for the departure date:

• After the ratification of the solicitude by the Buyer, a 30% down payment of the services will be debited through the bank card of the Buyer.
• The balance, that is, 70% of the remaining services price, will be debited from the bank card of the Buyer, 7 days before the departure date, at the latest.

If the solicitude is carried out less than 7 days from the departure date, the total amount of the Product price will be debited through the bank card declared by the Buyer at the time of his solicitude.

Upon partial or total lack of payment by the Buyer, Argentina Excepcion reserves the right to suspend or cancel the supply of the services corresponding to the Product hired, being responsibility of the Buyer the assumption of the expenses from this derived.

When the Buyer presents himself to retrieve the vehicle, he must leave his credit card information as a warrantee.

SECTION 7 – SOLICITUDE CANCELLATION

7.1. Modification request by the Buyer

If there were to be a modification request relative to non essential characteristics of the Product, Argentina Excepcion commits to join efforts in order to satisfy the Buyer’s request, without prejudice of the payment of 15 USD for administrative expenses per person. The modification expenses may vary according to the contractual procedures accorded between Argentina Excepcion and the carriers and/or local suppliers.

All modification requests regarding an essential characteristic of the Product object of the solicitude and/or resulting impossible to satisfy and/or solicited less than 15 days before departure will be considered as a cancellation request subject to the terms detailed in the subsequent paragraphs.

7.2. Cancellation request by the Buyer

All cancellation request formulated by the Buyer must be directed imperatively by e-mail to info @ argentina – excepcion . com or by fax to (0054) 11 4772 6620 or by certified letter with acknowledgement of receipt to the following address: Argentina Excepcion – Costa Rica 5546 – 6° Floor, Apartment “606” – (C1414BAA) Buenos Aires – Argentina.

7.3. Cancellation terms

Except for the particular statements which appear in the selected Product description, which may be more restrictive (especially, during school holidays), the measures detailed below will be applicable to the cancellation requests formulated by the Buyer:

• More than 7 days before the reception : 10 % of the price of the rent
• Between 7 and 4 days before the departure : 20 % of the price of the rent
• Less than 4 days before the departure : 30% of the price of the rent

All cancellation or modification requests formulated by the Buyer will give way to the reimbursement of the sums paid out, previous deduction of the sums owed in virtue of the application of the measures previously detailed as well as the bank commissions.

7.4. Cancellation by Argentina Excepcion

In a case in which due to its own insufficiency Argentina Excepcion would be forced to cancel Product object of the solicitude, the agency will offer the Buyer an equivalent Product. If the Buyer were to reject it, Argentina Excepcion commits to reimburse the full amounts paid out by the Buyer. Likewise, Argentina Excepcion commits to offer an equivalent compensation equal to the sanction the Buyer would have received if the cancellation would have occurred due to his fault.

When, due to force majeur, Argentina Excepcion would be forced to cancel the Product object of the solicitude, the agency will offer the Buyer an equivalent Product. If the Buyer were to reject it, Argentina Excepcion commits to reimburse the full amounts paid out by the Buyer, without an additional compensation and within the limits imposed by the will to reimburse manifested by the supplier involved.
